What's included in final pay?

Per DOLE Labor Advisory No. 06-20, final pay (also called back pay or last pay) includes: unpaid salary for days already worked, prorated 13th month pay, cash conversion of unused Service Incentive Leave (at least 5 days/year by law) and company leave credits, separation pay when applicable, and any other amounts under company policy or contract — minus taxes, loans and accountabilities.

When must it be released?

DOLE requires release within 30 days from the date of separation, unless a more favorable company policy or agreement applies. If your employer won't release it, you can file a request for assistance at the nearest DOLE office (SEnA).

Daily rate: how to get it

If you only know your monthly salary, the usual divisors are 26 days (6-day work week) or 22 days (5-day). Payroll formulas also use the annual factor (313 or 261 days ÷ 12) — your payslip or HR can confirm which applies.
